Despite continuing non-payment for more than two decades, Hanspal somehow escaped eviction by filing lawsuits and declaring bankruptcy according to court records.
The property was seized a long time ago and is now owned by Diamond Ridge Partners, which recently sued Hanspal to evict him.
But Hanspal again evaded eviction during Wednesday’s hearings in Nassau County Court, when Judge William A. Hohauser adjourned the case after Hanspal’s attorney, William D. Friedman, pleaded for more time to deal with the case as his second lawyer David Gevanter had been hired on the case just the day before.
The move does not appear to be new in Hanspal’s scenario, and attorney Diamond Ridge told the presiding judge about it.
“This is the last of about 40 attorneys who appeared on the eve of the hearing, ”Diamond Ridge attorney Jordan Katz told Judge Hohauser.
Diamond Ridge employee Max Sold added: “This is very typical of the defendant – he uses lawyers to buy more time. This guy is actually making fun of the courts. “
When approached him post office Hanspal’s lawyer pointed to the state’s moratorium on evictions on why Hanspal had not paid off its mortgage all this time, stating that New York Governor Andrew Cuomo made paying rent a “moral obligation.”
However, Hanspal’s non-payment certainly predated the pandemic by about 20 years. Moreover, eviction protection due to the pandemic only apply to those facing hardship as a result of the pandemic and therefore most likely does not apply to Hanspal as it did not make payments long before the start of the pandemic.
